ORDINANCE NO. 164
AN ORDINANCE AMENDING CHAPTER 18 OF THE WAHPETON CODE OF ORDINANCES CONCERNING THE CITY CLERK/ADMINISTRATOR.
WHEREAS, the Wahpeton City Council has determined that the Wahpeton City Clerk should also be designated as the City Administrator and should perform duties in that capacity.
NOW, THEREFORE, BE IT ORDAINED by the Wahpeton City Council that Chapter 18 of the Wahpeton City Code is amended as follows:
Section 1. Section 18.01 entitled “Appointment and Compensation” is amended by repealing the existing provision and by adopting the following replacement provision:
“18.01 APPOINTMENT AND COMPENSATION. The City Council shall appoint a City Clerk/Administrator. The Clerk/Administrator shall receive such compensation as established by resolution of the Council. The City Clerk/Administrator serves at the pleasure of the Council, subject to removal pursuant to Section 372.15 of the Code of Iowa.”
Section 2. There is hereby adopted a new Section 18.14 of the Wahpeton City Code as follows:
“18.14 ADMINISTRATOR’S DUTIES. The duties of the City Administrator shall be as follows:
A. Attend all meetings of the Council unless excused by the Mayor or majority of the Council members.
B. Recommend to the Council such measures as may be necessary or expedient for the good government and welfare of the City.
C. Generally supervise and direct the administration of the City government.
D. Supervise and conduct the business affairs of the City and cause accurate records to be kept by modern and efficient accounting methods.
E. Supervise the construction, improvement, repair, maintenance and management of all City properties, capital improvements, and undertakings of the City, including the making and preservation of all surveys, maps, plans, drawings, specifications and estimates for capital improvements.
F. Be directly responsible to the Council for the administration of the City as directed by the Council. All City departmental administration requiring the attention of the Council shall be brought before the Council by the Administrator.
G. Cooperate with, assist and advise all administrative agencies, City boards and commissions and act as the Council’s liaison and representative to such entities.
H. Investigate the affairs and conduct of any department, agency, officer or employee of the City, as deemed appropriate.
I. Keep the Council fully advised of the financial and other conditions of the City and of its future needs.
J. Advise, assist and consult with the City Attorney on all City legal matters.”
Section 3. All ordinances or parts of ordinances in conflict with the provisions of the new Wahpeton City Code are hereby repealed.
Section 4. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section 5. This ordinance shall be in effect from and after its final passage, approval, publication or posting as required by law.

Anderson/Wharton made a motion to appoint Keith Wurtz as 2018 Board Chairman and Wanda Nelson as 2018 Vice Chairman. Motion passed unanimously.
Kiley Miller, CEO of Iowa Lakes Corridor Development Corporation presented a review of their programming and recent projects. He requested a contribution of $2,500. The Board requested that staff put this in the next budget.
Anderson/Prunty made a motion to approve publication of 2017 wages according to Iowa Code Section 372.13(6). Keith Wurtz $825, Wanda Nelson $900, Michael Anderson $900, Suzanne Prunty $900, Kevin Wharton $900, Eric Stoll $94,606.36, Paula Nordblad $61,021.16, Linda Ruble $42,136.72, Logan Davids $75,797.89, Mark Hale $66,951.29, Ethan Rader $44,852.67, David Coleman $80,799.50, and Wade Newcomer $65,005.68.
Staff presented an estimated cash flow projection for the receipts from the End User Charge and the Board indicated that they were comfortable with using these funds for the 230th Ave Water Main Project.
Items discussed in the Manager’s Report:
• Chairman Wurtz noted that a customer had approached him regarding partnering with MMU for a solar project. Manager Stoll updated the Board mentioning that DGR will be at the February meeting to present their findings of the Feasibility Study.
• The Manager met jointly with the County and the City regarding the 13th St project. The County is a small player financially on the project and is on board whenever the City is ready. Mayor Anderson may want to wrap the rest of H Ave into this project. Manager Stoll stated that 13th Street will benefit MMU water system. The Manager noted that the new Mayor wants to form an infrastructure committee.
• Milford has a diverse mix of generation resources. We have an opportunity to commit to purchase wind energy, in the Southwest Power Pool RTO. Most of the NIMECA members are planning to make a commitment for this energy. The Board suggested that we take a look at this.
• Staff is working on the budgets for 2019 and will be presenting them in February.
• The Manager requested serious illness leave so that he could travel for a family members’ surgery.
• The Manager updated the Board regarding an employee who has been on medical leave. Discussion followed regarding the 90 days until our Long-Term Disability Policy kicks in. Staff who take call or work overtime are able to bank hours so that, in combination with sick leave accrual would fill that gap. Office and salary personnel do not have the opportunity to bank this time and therefore have a gap in coverage.
The Board of Trustees adjourned the meeting. The next regular meeting of the Milford Municipal Utilities Board of Trustees will be February 6, 2018.

The Terril City Council met in regular session on January 8, 2018 at 6:00 PM at Terril Memorial Building. The meeting was called to order at 6:00 P.M. by Mayor Darrell Woods Jr. The following councilpersons were present: Austin Fairchild, Jeri Nissen, Ron Soat, Julie Thiesen, Ken Trojahn. Absent: None. Others present: Tim Matthews, Scot Matthews, Dar Sheldon, and Dana Loring. |
Unless otherwise indicated, all of the motions offered at this meeting were carried with the following vote: Ayes: Fairchild, Nissen, Soat, Thiesen, Trojahn. Nays: None. Abstentions: None.
Motion by Nissen and seconded by Thiesen to approve the agenda. Motion Carried.
Motion by Trojahn and seconded by Fairchild to approve Purchase Order #7209, & #7210. Motion carried.
Motion by Nissen and seconded by Thiesen to approve the minutes of the December 11, 2017 meeting as presented. Motion Carried.
Motion by Trojahn and seconded by Soat to approve the claims of the city as presented. Motion Carried.

The Wahpeton City Council met on Monday, January 8, 2018 at 5 p.m. in Wahpeton City Hall. Present were Mayor Phil Johnson, Councilmen Tom Rierson, Jack Jones, LeAnn Blau and Harold Prior. Under reports: City Atty. Hemphill discussed the CIP, Hanna updated council on a sanitary inspection and survey and also weather related service line breaks. Radcliffe updated council on snowplow issues and information on a mower. Tielbur took reservations for an upcoming Great Lakes Regional meeting, and reported on an ICAP grant and progress with water rates and budget figures.
Being no further business, Mayor Johnson moved to adjourn the meeting at 5:31 p.m. All ayes – motion carried.

Lake Park City Council met in regular session on 1-08-18 at City Hall. Mayor Engel called meeting to order at 7:00PM with Pledge of Allegiance. Members present: Taber, Schumacher, Ehlers, Reekers, Baumgarn and Clerk Matthiesen. Also present: Mike Flannigan, Roxie Reekers, Tony Urwin, Ryan Carpenter, Jerry Wallace, Herb Stewart and April Bosma.
Moved by Schumacher/Baumgarn to approve consent agenda which includes the following: Minutes of 12-11-17 Meeting; Financial Reports; Approval of Bills for Payment; Consider Resolution #1-18 RESOLUTION PROVIDING FOR MILEAGE REIMBURSEMENT FOR EMPLOYEES OF THE CITY OF LAKE PARK, IOWA; Approve Liquor Permit for Cap’n Kens Pending Dram Shop. Roll call vote: AYES – Schumacher, Taber, Baumgarn, Reekers, Ehlers. NAYS – none; motion carried; resolutions duly adopted.

. OLD BUSINESS: Discussion took place concerning the camp fee rates for the 2018 season. After much discussion both in favor and in opposition of rate increases it was moved by Baumgarn/Taber to raise the rates as presented in the packets. AYES—Schumacher,Taber,Baumgarn,Ehlers. Abstain--Reekers
NEW BUSINESS: Julie Schieb and Bob Shaw presented both a statistical and financial/budget report on the Discovery House. They requested that the City take into consideration their continued support as they work on budget.
Mike Flannigan with Shamrock Recycling presented the council with a new 4-year contract for cardboard recycling. Moved by Taber/Schumacher to approve a 4-year contract with Shamrock Recycling for cardboard recycling; all ayes.
Moved by Schumacher/Ehlers to transfer $7500.00 of LMI(low to moderate income) funds collected on the Frerichs Development to the LPHA (Lake Park Housing Authority): all ayes.

CONSTRUCTION EVALUATION RESOLUTION
WHEREAS, Iowa Code Section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and
WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2018 and January 31, 2019 and submit an adopted recommendation regarding that application to the DNR; and
WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF DICKINSON COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3). Roll call vote: Johnson-aye, Allen-aye, Fairchild-aye, Jordan-aye. Leupold-aye.
Moved by Allen, seconded by Jordan to set the 2018 reimbursable mileage rate for Dickinson County employees at 54.50 cents per mile, the 2016 Federal Standard Mileage Rate for Business as issued in IRS-2016-169 Newswire Document. Roll call vote: Allen-aye, Jordan-aye, Johnson-aye, Fairchild-aye, Leupold-aye.
Moved by Allen, seconded by Fairchild to set the time and date for a Completion Hearing in Joint Drainage District 61, CDE (Clay, Dickinson, and Emmet County) for Tuesday February 13, 2018 at 2:00 p.m. in the Boardroom of the Dickinson County Courthouse. Roll call vote: Allen-aye, Fairchild-aye, Johnson-aye, Jordan-aye and Leupold-aye.
Moved by Johnson, seconded by Fairchild to approve the application of Schnell Bros, LTD owners of Okoboji View Golf Course for a Class C Liquor License (LC) Commercial permit effective January 4, 2018. Roll call vote: Johnson-aye, Fairchild-aye, Allen-aye, Jordan-aye, Leupold-aye.
County Engineer Dan Eckert present. Moved by Allen, seconded by Fairchild to approve the repair work for Doug Pringnitz in Drainage District # 28, Section 17 of Richland Township. The cost of the repair should be approximately $3600. Roll call vote: Allen-aye, Fairchild-aye, Johnson-aye, Jordan-aye, Leupold-aye.

OKOBOJI COMMUNITY SCHOOL
The Okoboji Community School Board of Education met for their regular meeting on January 8, 2018 in the Conference Room of the District Administrative Office at 5:30 p.m. Members present: Droegmiller, Dodge, Johnson, Hansen; Members absent: Weaver. Secretary: Sporrer. Administrators: Abrahamson.
President Hansen called the meeting to order at 5:30 p.m. A roll call of members present was taken with Hansen, Droegmiller, Johnson, Dodge present; Weaver absent. President Hansen read the Okoboji School District Mission and Tagline. The Pledge of Allegiance was recited.
Johnson/Droegmiller moved to amend the agenda to add I. Consent Items, 7. Staff Resignations, Nate Dau, .5 HS Strength and Conditioning Coach and II. Discussion and Action Items, 3. Finance b. Approve FEH Professional Services Contract. All yes votes/carried.
Droegmiller/Johnson moved to approve the following consent items: Minutes, bills, Statement of Revenues/Expenditures and Key Financial Measures as presented. Staff Resignations: Justin Bouse, Elementary principal; Scott Dodge, Assistance varsity football coach; Brenda Jones, Middle school volleyball and track coach. Staff Hires: Justin Bouse, Administrator-Student Services Director/Activities Director, $87,931.14/school year; Jessica Sandy, Teacher, $19,652.49 for a term of 7 school months; Jessica Sandy, Middle school track coach, $2,126.25/school year; Paula Krogman Tietz, Teacher Associate, $10.25/hour; Laura Waits, Teacher Associate, $10.75/hr. Yes votes: Droegmiller, Johnson, Hansen; Abstain: Dodge/carried.
Board members were assigned to read pages 13-21 in their IASB 2017-18 Board Member Handbook. Abrahamson informed the board on School Bond Activities including an updated estimated tax rate increase for the 20 year $25,000,000 of $1.25 down from $1.30.
There were no Open Enrollment In or Out requests. No action needed.
Sporrer and Abrahamson went over the long range financial plan for the SAVE and PPEL accounts.
The FEH Professional Services Contract was tabled. The board would like to have a drawing count and would prefer that the cost be $4,000 to $5,000 per drawing.
Hansen and Abrahamson will attend the 2018 Day on the Hill on January 30, 2018.
Hansen handed out Superintendent Evaluation Forms and would like them returned by February 12, 2018.
Droegmiller/Weaver moved to adjourn the meeting at 6:44 p.m. All yes votes/carried. The next regular meeting will be February 12, 2018 in the Conference Room of the District Administrative Office at 5:30 p.m.
