You are notified that a petition has been filed in the office of this court naming you as a defendant in this action. The petition was filed on July 19, 2017, and prays for foreclosure of Plaintiffs Mortgage in favor of the Plaintiff on the property described in this notice and judgment for the unpaid principal amount of $20,035.50, with 4.875% per annum interest thereon from October 1, 2014, together with late charges, advances and the costs of the action including (but not limited to) title costs and reasonable attorney’s fees, as well as a request that said sums be declared a lien upon the following described premises from May 23, 2003, located in Dickinson county, Iowa:

The petition further prays that the Mortgage on the above described real estate be foreclosed, that a special execution issue for the sale of as much of the mortgaged premises as is necessary to satisfy the judgment and for other relief as the Court deems just and equitable. NOTICE

The plaintiff has elected foreclosure without redemption.  This means that the sale of the mortgaged property will occur promptly after entry of judgment unless you file a written demand with the court to delay the sale.  If you file a written demand, the sale will be delayed until twelve months (or six months if the petition includes a waiver of deficiency judgment) from the entry of judgment if the mortgaged property is your residence and is a one-family or two-family dwelling or until two months from entry of judgment if the mortgaged property is not your residence or is your residence but not a one-family or two-family dwelling.  You will have no right of redemption after the sale.  The purchaser at the sale will be entitled to immediate possession of the mortgaged property.  You may purchase at the sale.

PUBLIC NOTICE

The Wahpeton Board of Adjustment will conduct a Public Hearing on Thursday, September 21, 2017 at 5:00 pm in the Wahpeton City Hall to consider the following:

- A construction permit request submitted by Larry or Mary Lou Wielenga, of 1306 Dakota Drive, Milford, IA 51351. The Wielenga’s are requesting a variance for their property to build a garage and breezeway addition to the house. The current structure is non-conforming and does not meet the current zoning setbacks of 165.04.5 Residential District setbacks.

- A construction permit request submitted by Charlie and Judy Kneip of 2523 Lakeshore Drive, Milford, IA 51351. The Kneip’s are requesting a variance to replace the existing deck of 11’x12’ with a new deck of 15’ x 21’9” on the lakeside of the residence. The current property does not meet the Lake Frontage Residential District setbacks 165.05.5 for the rear yard setback of 35 ft.

- A construction permit request submitted by Paul and Robin Stoupa of 1304 Joy Loy Lane, Milford, IA 51351. Stoupa’s are requesting a variance to replace their current balcony with a larger balcony of 7’ x 16’ which is on the lake (canal) side of the property. The property currently does not meet the current zoning setbacks of 165.04.5 Residential District setbacks.

Rick Kalsow representing the Lakes Area Youth Trap Club, is asking to either lease or purchase the land owned by Dickinson County located in Section 8 of Lakeville Township also known as the Neppl Pit. Kalsow reported that the present gun club has outgrown its present site. The county engineer has reported that there is very little gravel left to be removed from the pit. Kalsow informed the board that he has a donor that is willing to help fund the purchase of the property. The Board will revisit Mr. Kalsow’s request after an appraisal has been done for the property.

Assistant County Engineer John Miller present. Moved by Johnson, seconded by Fairchild to approve a temporary road use agreement with Upland Prairie LLC to use public roads in Dickinson County for construction of the wind farm in the southwest part of the County. Roll call vote: Johnson-aye, Fairchild-aye, Allen-aye, Jordan-aye, and Leupold-aye.

Moved by Johnson, seconded by Fairchild to approve the Drainage Facilities Agreement with Upland Prairie LLC to repair any drainage facilities, including surface and subsurface, that could potentially be damaged in the construction of the wind farm in the southwestern part of Dickinson County. Chair Leupold suspended the meeting in order to have a public hearing for the Preliminary Engineering Report for Joint Drainage District 61, CDE-Branch 61.10:15 A.M.

10:15 A.M. The Dickinson, Clay, and Emmet County Board of Supervisors met as trustees of Joint Drainage District #61 CD, & E at 10:15 A.M.

Chairman Leupold opened the meeting.

Present: Clay: Barry Anderson, Dan Skelton, Joe Skow; Dickinson: Supervisor’s Paul Johnson, Mardi Allen, Pam Jordan, Tim Fairchild, William Leupold, Assistant County Attorney Lonnie Saunders, and Deputy Auditor Boots Gross; Emmet: John Pluth, Jeff Quastad, Roger Hash. Telephonically present are Palo Alto Supervisors and: Keith Wirtz, Ron Graettinger, Roger Faulstick, Craig Merrill, Linus Soldberg, and Auditor Carmen Moser.

Moved by Dickinson County Supervisor Mardi Allen, seconded by Clay County Supervisor Barry Anderson to appoint Dickinson County Supervisor William Leupold as Chairperson for the meeting. All voted aye.

Moved by Emmet County Supervisor John Pluth and seconded by Clay County Supervisor Barry Anderson to appoint Dickinson County Deputy Boots Gross as secretary for the meeting. All voted aye.

Time for the Public Hearing on the Preliminary Engineering Report for Joint Drainage District 61, CDE-Branch 61. Rick Hopper from Jacobson-Westergard & Associates present. Hopper gave an update on the work being done. Moved by Clay County Supervisor Barry Anderson, seconded by Emmet County Supervisor John Pluth, to close the Public hearing. All voted aye.

Moved by Emmet County Supervisor, Jeff Quastad, seconded by Clay County Supervisor, Dan Skelton, to approve and accept the Engineering Report for Joint Drainage District 61, CDE-Branch 61 as presented. All voted aye.

Time for the Public Hearing on proposed annexation of Palo Alto Lands into Clay, Dickinson, and Emmet counties Joint Drainage District 61, Open Ditch. Rick Hopper, engineer from Jacobsen and Westergard informed the group that Palo Alto had approximately 258 acres within the drainage ditch. Moved by Emmet Supervisor Jeff Quastad, seconded by Dickinson County Supervisor Pam Jordan to close the public hearing. All voted aye.

Moved by Emmet County Supervisor John Pluth, seconded by Dickinson County Supervisor Mardi Allen approved the annexation of Palo Alto lands into Joint Drainage District CDE-Open Ditch. All voted aye.

Rick Hopper updated the board on the project. .He also informed all present that Palo Alto had two options regarding the annexation. Palo Alto could either be part of the joint ditch by agreeing to become a four county joint drainage district or could choose to just be informed of the decisions and allow the control county notify the landowners of Palo Alto County. Hopper also informed Palo Alto that they could choose to join the joint ditch at a later date. . Palo Alto chose not to become a fourth county in the joint ditch but instead wanted the control county to inform Palo Alto County of decisions regarding the drainage ditch and to notify the landowners when needed. Hopper could not stay any longer at the meeting as he had another appointment but his associate Dallas Heikens will open the bids and do the tabulations.

As there was no further items presented to the joint boards, it was moved by Emmet County Supervisor Jeff Quastad, seconded by Dickinson County Supervisor Mardi Allen, to adjourn. All voted aye. Palo Alto County left the meeting at 10:45 A.M.

After checking the math and making sure all bids were submitted with insurance coverage, it was recommended by Jacobsen and Westergard to accept the low bid of Rezac Machine Shop from Ringsted, IA at the cost of $84, 315.40 for the Joint Drainage District #61, CD &E project.

Moved by Allen, seconded by Fairchild, to approve payment application #1 in the amount of $60, 498.90 and change order #1 for TAP-R-C030(051)—8T-30. Roll call vote: Allen-aye, Fairchild-aye, Johnson-aye, Jordan-aye, and Leupold-aye.

Erin Reed, Trails Director, present. She informed the Board of a Trails work permit she would like implemented before any work could be done within the right of way of the trail system. The permit would have certain regulations and policies that would require all work would be done to maintain the trail right of ways and make sure contractors restored the trail right of ways in proper condition. Moved by Allen, seconded by Jordan, to approve a Work-or-Trail R-O-W Easement Permit. Roll call vote: Allen-aye, Jordan-aye; Johnson-aye; Fairchild-aye, Leupold-aye.

Reed also informed the board that Power Engineers/CenturyLink have applied for a permit to run a fiber cable parallel along the trail along 15th St between Keokuk Ave and Peoria Ave crossing Memphis Avenue. After the discussion, the Board would like Reed to defer back to the Trails Board and come up with a workable policy that would benefit the Trails economically and would be more comprehensive overall. No action was taken at this time.

The board gave their board and committee reports and non-actionable items were discussed.

There being no further items presented to the board this 22nd day of August, 2017 it was moved by Johnson, seconded by Fairchild, to adjourn. All voted aye.

OF ADJUSTMENT

PUBLIC HEARING NOTICE ON THE

CONSIDERATION OF VARIANCE REQUEST

Pursuant to the Requirements of Section 23.3 of the Orleans Zoning Ordinance the Board of Adjustment will conduct a public hearing for a requested variance by Kuhlman Lake Service for property located at 239 252nd Avenue, Orleans, Iowa 51360. Arnolds Park/Okoboji Fire and Rescue Board Meeting Minutes

September 6, 2017, 4:30PM, Okoboji Station Classroom

The meeting was called to order at 4:35PM by President Jerry Robinson with Board members John Adams and Jerry Thielen in attendance. Also present was Fire Chief Chris Yungbluth. The agenda was reviewed and no changes were made. The Consent agenda to include the past two months bills were review and the July meeting minutes will be reviewed in October due to no August meeting being held. Motion to approve the consent agenda made by Adams, seconded by Thielen unanimous approval. No new expenditures were brought forward.

OLD BUSINESS

Chief reported that he is still waiting on the defibrillators to arrive for the Okoboji Police Department.

NEW BUSINESS

Chief Yungbluth reported that the recent Labor Day Auction Fundraiser was very successful with a little over $11,000 dollars raised. He also reported that several members are celebrating years of service anniversaries to include: Eric Holdeman 2 years of service, Tom Struthers 3 years of service, Andy Yungbluth 6 years of service and Andy VanSchepen 9 years of service. He also reported that the department responded to 6 Fire and 29 EMS responses for the month of July and 7 Fire Responses and 31 EMS responses for the month of August.

Upcoming events were reviewed and no Open discussion items were brought up. Meeting was adjourned at 4:55PM with the next meeting to be held October 4th at 6:00PM at the Okoboji Station Meeting room.

PUBLIC HEARING NOTICE

Public notice is hereby given that the Board of Adjustment for the City of Okoboji, Iowa will conduct a public hearing on September 25th, 2017 at 6:00 P.M. in the Okoboji City Hall to consider a variance request by Robert & Cynthia Cramer, owners of record of Lots 22 and 23, Haywards Bay, Dickinson County, Okoboji, Iowa commonly known as 5513 Lakeshore Drive.

The Cramers are requesting a variance to extend the existing roof of the existing house over the existing deck and to build a ten foot pergola over the remaining eight feet of open deck. The existing house and deck encroach into the side yard setback. The proposed construction represents an expansion of an existing nonconforming use, as stated in Section 14.3 of the Okoboji Zoning Ordinance. Non-conformities are not allowed as defined in Article XIV General Regulations. This precludes the Cramers from obtaining a construction permit.

Any party of interest may appear in person or by legal counsel to express their views either in support of or against the granting of the variance. Written comments shall be delivered to the office of the City Clerk not later than 4:00 P.M. on the above date.
