Public Notice

PUBLIC NOTICE IS HEREBY GIVEN that the Board of Adjustment for the City of West Okoboji, Iowa will conduct a public hearing on August 25, 2017 at 2:00 P.M. in the West Okoboji City Hall at 501 Terrace Park Blvd to consider a variance request by Tom and Kim Van Overbeke, for SLY part of lot 10 and all of lot 11 Titterington plat and tract 30’ x 128.72’ x 21.67 x 124.59’ E side of Lot C Pocahontas Point, Dickinson County and West Okoboji, Iowa, commonly known as 2103 Okoboji Blvd.

Van Overbeke is requesting a variance for an addition to a non-conforming single family home. The setback requirements as defined in Article VII Residential District ( R ) Section 7.5 Site Development Regulations of the Zoning Ordinance of the City of West Okoboji cannot be met at this time. A variance of 9’ into the required front yard is being requested on the ENE side of the property for a proposed porch. A variance of 5.7’ into the required front yard is being requested on the ENE side of the property for a proposed garage. The proposed construction constitutes a non-conformity to an already non-conforming home. This precludes Tom and Kim Van Overbeke from obtaining a construction permit.

Any party of interest may appear in person or by legal counsel to express their views either in support of or against the granting of the variance building permit. Written comments shall be delivered to the office of the City Administrator not later than 12:00 P.M. on the above date.

The Spirit Lake Community School Board of Directors met in special session on August 8, at 8:00 a.m. in the District Office Board Room at 2701 Hill Avenue. Present were board members Todd Hummel, Teresa Beck, Keith Brockmeyer and Sonja Hamm. Absent was Scott Trautman. Also present were David Smith-Superintendent, Donna Sebert-Board Secretary, Karen Oleson-Director of Business & Finance, 2 staff members and 1 visitor.

President Todd Hummel called the meeting to order, the Pledge of Allegiance was recited.

Terril City Council Meeting

August 7, 2017

The Terril City Council met in regular session on August 7, 2017 at 6:00 PM at Terril City Hall. The meeting was called to order at 6:00 P.M. by Mayor Darrell Woods Jr. The following councilpersons were present: Jeri Nissen, Ron Soat, Julie Thiesen, Ken Trojahn. Absent: Brian Brawner. Others present: Jan Torkelson, James Liessmann, Scot Matthews, Tim Matthews, and Dana Loring.

Unless otherwise indicated, all of the motions offered at this meeting were carried with the following vote:  Ayes: Nissen, Soat, Thiesen, Trojahn. Nays: None.  Abstentions: None

Motion by Nissen and seconded by Thiesen to approve the agenda. Motion Carried.

Jan Torkelson was present to update council on automation progress at the library. The Summer Reading Program, a Book Walk, and Pre-School Reading were also discussed, as well as the on-going maintenance needs of the library including cleaning, painting and the repairs needed to the west wall.

James Liessmann would like to purchase approximately 1 acre of land south of his property on S State Street. The Council tabled action on this proposal until the September 11, 2017 regular meeting.

Motion by Soat and seconded by Trojahn to approve the minutes of the July 10, 2017 meeting and the July 18, 2017 meeting as presented. Motion Carried.

Motion by Soat and seconded by Trojahn to approve the claims of the city as presented. Motion Carried.

Motion by Nissen and seconded by Thiesen to approve the Treasurer’s Report. Motion carried. July receipts totaled $40,803.82 and July disbursements totaled $40,859.53. Motion carried.

Motion by Thiesen and seconded by Soat to approve Resolution 2017-13, Funds Transfer Resolution. Motion Carried.

Motion by Nissen and seconded by Thiesen to approve Resolution 2017-14, Wage Resolution.

Aye: Nissen, Soat, Thiesen, Nae: None. Abstain: Trojahn. Motion carried.

Motion by Nissen and seconded by Soat to approve building permit for Dari Fehr. Motion Carried.

The council is in the process of updating the Terril Code of Ordinances. Among those being reviewed are Fireworks Ordinance, House Moving Ordinance, Dangerous Animal Ordinance and others.

The City Council and Planning & Zoning Board will meet to review and update the Terril Zoning Ordinance on Tuesday, August 15 at 6:30 pm at the Terril Memorial Building.

The September regular City Council meeting will be held Monday, September 11, 2017, at 6 PM at Terril City Hall.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ARNOLDS PARK, IOWA, 2004, TO ALLOW THE SALE OF FIREWORKS WITHIN THE CITY OF ARNOLDS PARK.

BE IT ENACTED by the City Council of the City of Arnolds Park, Iowa:

SECTION 1. SECTION MODIFIED. Chapter 41.11 FIREWORKS. Paragraph 2 Regulations. It is lawful for any person to offer for sale, expose for sale, sell at retail. However, it is unlawful to use or explode any fireworks; provided the City may, upon application in writing, grant a permit for the display of fireworks by a City agency, fair associations, amusement parks and other organizations or groups of individuals approved by City authorities when such fireworks display will be handled by a competent operator. No permit shall be granted hereunder unless the operator or sponsoring organization has filed with the City evidence of insurance in the following amounts:

• Personal Injury:-$250,000.00 per person.

• Property Damage:-$50,000.00.

• Total Exposure:-$1,000,000.00.

SECTION 2. SERVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Beth Will, Safety Coordinator, present to give an update on the Iowa Municipal Workers Compensation Association annual report. This gives an overview of the safety and work loss for the county. She informed the Board that Scott Smith, a representative for IMWCA, was here for a site visit on July 6th and gave a very positive report for the excellent work Dickinson County has done implementing safety procedures for a safe workplace. He suggested a few recommendations that still needed to be addressed and added to the Policy and Procedures for a safe workplace.

Alissa Holtz, IT Director, present requesting that the County replace the present backup internet provider Century Link with Premier Communications. Moved by Allen, seconded by Johnson to approve a contract with Premier Communications to provide backup internet services at the cost of $624 a month as soon as possible. Roll call vote: Allen-aye, Johnson-aye, Fairchild-aye, and Leupold-aye.

Moved by Allen, seconded by Johnson to approve Clark Reekers, courthouse maintenance engineer, to tile around the circle by northwest corner of the tower at the cost of $2100 in order to drain the water away from the bushes and help the cement stay intact. The tile will connect to the tile that already has been installed to help aid in the drainage of the other side. Roll call vote: Allen-aye, Johnson-aye, Fairchild-aye, and Leupold-aye.

Clark Reekers, courthouse maintenance engineer, reported that he had contacted several contractors about the Hope Haven building and the need for upgrading the bathroom. He also reported that he has had two more contractors that will bring in bids this next week. It was suggested that he get bids for one unisex bathroom as well as a men’s restroom and a women’s restroom. Motion by Farmer seconded by Chappas to approve street closure on August 12, 2017 from 6-10PM of 35th Street for neighborhood block party. Motion carried unanimously.

PRESENTATION BY SPIRIT LAKE CHAMBER OF COMMERCE

Erin Davelaar, board member of the Spirit Lake Chamber of Commerce, discussed benefits of Spirit Lake Chamber of Commerce. Davalaar explained the hiring of a part-time position at the Spirit Lake office is an effort to service the community better. Discussion will held among Council members and Ms. Davalaar. It was suggested the Council and Spirit Lake Chamber directors meet again in two months. No further action was taken.

COMMENTS BY MAYOR, COUNCIL AND STAFF

City Administrator Owens explained quotes for the base for the sails project will be due in two weeks. The Parks Department has begun planting sedum plants on the ends of the boulevards.
