NOTICE TO BIDDERS

Public notice is hereby given that the Clay, Dickinson and Emmet County Boards of Supervisors will meet at the Dickinson County Courthouse in Spirit Lake, Iowa, on Tuesday, August 22, 2017 at 11:00 a.m., at which time said Boards propose to adopt plans, specifications and form of contract and to receive bids for the 2017 OPEN DITCH CLEANOUT in JOINT DRAINAGE DISTRICT NO. 61, BRANCH NO. 61, IN CLAY, DICKINSON AND EMMET COUNTY, IOWA, and to enter into the contract for the construction of said improvements. Proposals will be acted upon by the Boards at a meeting to be held on the day and hour above specified or such later time and date as may then be specified.

The proposed cleanout and repairs are in general as follows: Furnishing all labor, tools and equipment necessary for 21,220 cubic yards of excavation, repairing 7 outlets, clearing and grubbing, seeding and fertilizing, together with related subsidiary and incidental work in Joint Drainage District No. 61, Branch No. 61 in Clay, Dickinson and Emmet County, Iowa.

All materials are to be in strict compliance with specifications prepared by Jacobson-Westergard & Associates of Estherville, Iowa, which, together with the proposed form of contract, have heretofore been approved by the Boards and are now on file for public examination in the office of the Clay, Dickinson and Emmet County Auditors, and are by this reference made a part hereof as though fully set out and incorporated herein.

Each proposal shall have been sealed in an envelope and marked “Proposal for 2017 OPEN DITCH CLEANOUT in Joint Drainage District No. 61, Branch No. 61, Clay, Dickinson and Emmet County, Iowa.” Each bid must be accompanied in a separate envelope by a bid bond, cash or certified check in an amount equal to ten percent (10%) of the total bid, in no case to exceed $10,000, drawn on and certified by an Iowa Bank, made payable to the Dickinson County Auditor as security that the bidder will furnish the required bonds, and enter into a contract within 15 days after the award of the contract to them.

The successful bidder will be required to furnish a bond in the amount of the contract price, said bond to be issued by a responsible surety approved by the Boards and shall guarantee the faithful performance of the contract and the terms and the conditions therein contained, and shall guarantee the prompt payment of all materials and labor, and protect and save harmless the Boards from claims and damages of any kind caused by the operations of the Contractor for a period of one year from and after the acceptance of the work by the

Boards and guaranteeing the complete project against defective workmanship and/or materials for a period of one year from and after acceptance.

The Contractor shall have all work shall be completed by June 1, 2018. No leveling of spoil shall be done until crops have been harvested on crop ground. No leveling will be done on CRP acres between May 15th and August 1st. Approval must be obtained from the Engineer prior to commencing leveling operations. If the Contractor fails to complete the work within the specified time, he shall forfeit to the Boards $200.00 for each calendar day after this date that the work is incomplete.

Use of any excavator for cleanout which is not classified as a long-reach machine must be approved by the Engineer.

No benching will be allowed to reach the bottom of the ditch.

Excavation shall be done from both sides of the ditch throughout the length of the cleanout.

Payments shall be made in cash or stamped warrants paying 5% interest based on monthly estimates of work and material delivered and completed during the preceding month. The Boards shall pay the Contractor 90 percent of the monthly estimate. Final payment shall be made to the Contractor as set forth in the contract documents and as provided for in Chapter 455 of the Code of Iowa as amended.

Mayor VanderWoude opened the public hearing for questions or comments. Mayor VanderWoude explained that language had been added based on the Council meeting of 07/11/2017. Mayor VanderWoude read into the record the additional language. Mayor VanderWoude called for a discussion regarding the additional language. Councilmember Hentges thanked everyone for their hard work on this ordinance. Councilmember Andres stated that she had spoken to Chairman Primavera regarding his concern expressed at the last Council regarding conditional use permits. Councilmember Andres stated that Chairman Primavera had been given a copy of the new ordinance to review.

Notice is hereby given that the City Council of the City of Milford, Dickinson County, Iowa, will meet in the City Council Chambers of the City of Milford, Dickinson County, Iowa, on the 14th day of August, 2017, at 6:30 p.m. at which time the City Council of the City of Milford will hold a public hearing on a proposal to proceed with the vacation of a portion of N Avenue described as follows:

CITIZEN OPPORTUNITY FOR COMMENT

Residents from Q Avenue were present with concerns of vehicles speeding and children at play on Q Avenue from 4th Street to 10th Street. Mayor Reinsbach responded he would be in contact with the Police Department requesting staff to patrol the area heavily.

PUBLIC HEARING

Public hearing on 2017 City of Miford Alley Construction project @ 6:30 p.m.

Mayor Reinsbach opened the meeting at 6:37 p.m. Jim Studer business owner of Excel Auto Body was present inquiring on the timing of the project. Mayor Reinsbach communicated to Jim Studer between the City Engineer, the contractor and the City we will stay in contact and work with him to limit business closure. There was no oral and written comments received at the City Clerk’s office the public hearing was closed at 6:39 p.m.

Mayor Reinsbach opened the meeting at 6:40 p.m. With no comments from the audience or oral and written comments received at the City Clerk’s office the public hearing was closed at 6:41 p.m.

Resolution awarding bid for City of Milford 2017 Alley Construction project

Motion by Olsen second by Rolling to approve Resolution 17-30 awarding bid for City of Milford 2017 Alley Construction project to Hulstein Excavating, Inc. Roll call vote. Voting aye: Simpson, Olsen, Rolling, Walters and Huse. Nay: None Motion carried.

Resolution warding bid on City of Milford Sewer CIPP project

Motion by Rolling second by Huse to approve Resolution 17-31 awarding bid for City of Milford 2017 Sewer CIPP project to Visu-Sewer, Inc. Roll call vote. Voting aye: Simpson, Olsen, Rolling, Walters and Huse. Nay: None Motion carried.

Ordinance amending the City Code of Milford, Iowa by amending Chapter 122 Peddlers, Solicitors, and Transient Merchants: Section 122.04 Application and License: Section 122.05 License Fees: Section 122.07 License issued and Section 122.10 Time Restrictions

Councilmember Rolling introduced Ordinance 7-31-17 amending the City Code of Milford, Iowa by amending Chapter 122 Peddlers, Solicitors, and Transient Merchants: Section 122.04 Application and License: Section 122.05 License Fees: Section 122.07 License issued and Section 122.10 Time Restrictions and moved that the requirements that the ordinance be considered at two prior council meetings be waived. Councilmember Huse seconded the motion to waive the requirements that the ordinance be considered at two prior council meetings. Roll call vote: Voting aye: Olsen, Rolling, Huse, and Walters. Nay: None motion carried. A motion was made by Huse second by Simpson to adopt Ordinance 7-31-17 amending the City Code of Milford, Iowa by amending Chapter 122 Peddlers, Solicitors, and Transient Merchants: Section 122.04 Application and License: Section 122.05 License Fees: Section 122.07 License issued and Section 122.10 Time Restrictions. Roll call vote. Voting aye: Olsen, Rolling, Huse, and Walters. Nay: None motion carried

Appoint Board of Adjustment member

Olsen made a motion to appoint Joe Funk to Board of Adjustments with a second by Simpson. Ayes: Simpson, Olsen, Rolling, Huse and Walters. Nay: None Motion passed.

Resolution setting public hearing to vacate a portion of N Ave from 22nd - 23rd Street

Motion by Olsen second by Huse to approve Resolution 17-32 setting public hearing regarding proposal to vacate the portion of N Avenue north of 22nd street and south of 23rd street. Roll call vote. Voting aye: Simpson, Olsen, Rolling, Walters and Huse. Nay: None Motion Carried. Mayor Reinsbach recommended to the council to not consider P & Z’s recommendation of the 30 foot easement on the west side of the property due to parking needs. GrapeTree owner Tim Kinnetz commented if a 30 foot easement was placed on that property that would mean 70 less parking spots, with 70 less people without a job. The public hearing will be August 14, 2017 at 6:30 p.m.

Discuss former Gressley property located at 914 Okoboji Ave and working with Kiwanis Club and City of Milford Parks Dept.

Mayor Reinsbach communicated there was no commitment between Kiwanis and Park Board for maintaining the former Gressley property. Kiwanis member Virgil Wahlman was present in the audience inquiring what duties Kiwanis would be asked to do in maintaining the property. Mayor Reinsbach requested for Kiwanis to discuss what duties they would like to perform and return to the City Council.

Closed session pursuant to Iowa Code Chapter 21.5(j) to discuss the purchase of particular real estate

Motion by Walters, second by Huse to go into closed session to discuss the purchase of particular real estate. Aye: Simpson, Olsen, Rolling, Walters, and Huse. Nay: None. Motion carried. Council went into closed session at 7:03 p.m. Pursuant to Iowa Code 21.5(1)(j). Motion by Simpson, second by Rolling to come out of closed session. Aye: Simpson, Olsen, Rolling, Walters, and Huse. Nay: None. Motion carried. Council came out of closed session at 7:45 p.m.

COMMENTS BY MAYOR, COUNCIL, AND STAFF

Simpson commented he got a couple calls in regards to the delayed fireworks on Friday July 21st. Walters asked how we are coming with the Airport Easement agreements. Mayor Reinsbach and Deputy City Carrie Funk commented we have all but two, currently we do not have signed agreements from Rody Pederson and Dennis Klein.

DICKINSON COUNTY SANITARY LANDFILL COMMISSION

REGULAR SESSION-1:30 P.M.

JULY 27, 2017 – ARNOLDS PARK CITY HALL

MEMBERS PRESENT (Representing): Jason Eckard (West Okoboji), Jason Peters (Okoboji), Kevin Bice (Spirit Lake), Bill Maas (Orleans), Pam Jordan (Dickinson County Supervisor), Wanda Thielen (Arnolds Park).

ALSO PRESENT (Representing): Lou Lorenson (Waste Management), Charles Vigdal (Dickinson County Conservation Board).

Presiding: Bice called the meeting to order.

Agenda: Motion approving the agenda. Maas/Eckard. All ayes.

Minutes: Motion approving the minutes of the June 29, 2017 meeting. Peters/Eckard. All ayes.

Treasurer’s Report: Motion accepting the Treasurer’s Report. Beginning balance on June 1, 2017 was $9,107.46. Revenue for June was .07 and expenditures were $29.17. The ending balance on June 30, 2017 was $9,078.36. Maas/Bice. All ayes.

Outstanding Bills: We received a bill from Dickinson County Conservation Board in the amount of $24,881.18. It will be held on file until there is funds available for payment. Motion to pay Dickinson County News $31.00 balance owing. Maas/Eckard. All ayes.

Operations: Vigdal reported a screener was purchased in the amount of $11,523.28 from Argus Industrial Company. Vigdal reported the totals for the month of July, 2017. Green waste was $3,760.50, electronics was $1,018, appliances was $1,863, hhm was $258.25 and tires $179. Total was $7,078.75.

Landfill Update: Lorenson informed the Commission Waste Management is still trying to fill the manager position at the landfill. Thielen shared the information from Becky Holly, DNR regarding the tipping fees. Lorenson will provide a copy of the 28E Agreement to the Commission.

Open Discussion: Peters, City of Okoboji invited everyone to their Council meeting, August 8, 2017 regarding discussion of Emerald Ash Borer.
