REGULAR MEETING OF THE BOARD OF TRUSTEES OF

THE IOWA GREAT LAKES SANITARY DISTRICT

May 23, 2017 3:00 P.M.

DISTRICT OFFICE, MILFORD, IOWA

President Boettcher called the meeting to order at 3:00 p.m.; trustee Senn, Hoppe, Rohlfsen and Bailey were present.

Trustees approved an agreement with Leo Park Jr. and Debbie Parks to establish a new easement for the newly relocated 3-3 sewer force main and also convey the existing easement back to Leo Parks Jr. and Debbie Parks on the same property. (Hoppe/Bailey); all ayes.

Anderson explained the Alliant energy easement to the Trustees but the item was tabled until more details could be determined after the lot pins where located.

Anderson reported that the final pipe had been repaired for project 2014-1 Section B and hopes the project will be wrapped up shortly. Trustees were also informed about a locate request of a force main in Orleans.

Trustee Rohlfsen introduced Resolution 2017-14 ADOPTING SECTION 125 CAFETERIA PLAN WITH AND GIVING INSTRUCTION TO THE PLAN ADMINISTRATOR AND DIRECTING NOTIFICATION OF PLAN PROVIDES TO EMPLOYEES. The resolution was seconded by Senn. Roll was called and the vote aye – Senn, Hoppe, Bailey, Rohlfsen, Boettcher; nay – none. The president declared Resolution 2017-14 duly adopted.

Trustee Bailey introduced Resolution 2017-15 CERTIFYING DELINQUENT SEWER RENTAL ACCOUNTS TO THE COUNTY AUDITOR FOR ESTABLISHMENT OF LIENS AGAINST THE APPROPRIATE PROPERTIES AND COLLECTION OF SAME AS TAXES AS PROVIDED BY CHAPTER 358, CODE OF IOWA. The resolution was seconded by Rohlfsen. Roll was called and the vote aye – Senn, Hoppe, Bailey, Rohlfsen, Boettcher; nay – none. The president declared Resolution 2017-15 duly adopted.

Anderson explained options for receiving payments for credit and debit cards for sewer rental payments. Anderson was directed to get the payment process set up with the current billing software vender White Mountain which no fees for processing are charged to the Sanitary District.

Anderson discussed some new equipment items to consider in the fiscal 2018 budget.

Meeting called to order by Chairman, William Leupold.

The pledge of allegiance to the flag was recited by those present.

Moved by Jordan, seconded by Allen, to approve the May 16, 2017 Board Meeting Minutes as presented to the board. Roll call vote: Jordan-aye, Allen-aye, Johnson-aye, Fairchild-aye, and Leupold-aye.

Move by Allen, seconded by Jordan, to approve the employment of Amy Russell as a part time dispatcher in the Sheriff’s Department. Russell’s employment begins on June 2, 2017 at an hourly rate of $17.91 per hour. Roll call vote: Allen-aye, Jordan-aye, Johnson-aye, Fairchild-aye, and Leupold-aye.

Moved by Allen, seconded by Johnson, to approve the employment of Jacob Oeth as an intern in the County Attorneys Department. Oeth‘s employment began on May 17, 2017 at an hourly rate of $15.00. County Attorney Jon Martin informed the board that the Iowa Attorney General’s office may reimburse the county $5.00 per hour up to $5000.00 for Oeth’s salary. Roll call vote: Allen-aye, Johnson-aye, Fairchild-aye, Jordan-aye, and Leupold-aye.

Moved by Allen, seconded by Jordan, to approve Fireworks Display Permit for Nadine Johnson. The operator will be Laura Bovard. The display will be at 354 Elm Drive in Arnolds Park, Iowa, on July 4, 2017. The proper liability insurance certificate has been provided with the permit application. On the advice of Assistant County Attorney, Lonnie Saunders, the motion was rescinded and will be discussed at the next scheduled meeting. Saunders wanted to clarify the new State law regarding the sale of fireworks in relationship to issuing permits by local authorities.

At 10:00 A.M., Chair Leupold opened the Public Hearing on the FY’17 Proposed Budget Amendment. With no written or oral objections received by the Auditor or Supervisors, moved by Fairchild, seconded by Johnson, to authorize Chair Leupold to close the Public Hearing. Public Hearing closed.

Moved by Fairchild, seconded by Johnson, to approve RESOLUTION 2017-9, BUDGET AMENDMENT RESOLUTION FY’17. BE IT RESOLVED, by the Dickinson County Board of Supervisors, that the amended budget for FY’17 be approved as published in the official newspaper of the County on Wednesday May 10, 2017. Roll call vote: Fairchild-aye, Johnson-aye, Allen-aye, Jordan-aye, and Leupold-aye.

Moved by Allen, seconded by Jordan, to approve RESOLUTION 2017-10, APPROPRIATIONS AMENDMENT-CHANGING DEPARTMENTAL APPROPRIATIONS. WHEREAS, the Board of Supervisors of Dickinson County has held a Public Hearing pursuant to Iowa Code 331.434(3) to amend FY’17 County Budget; AND, WHEREAS, the amendment does not increase the taxes to be collected in the fiscal year ending June 30, 2017; AND, WHEREAS, all comments from the public have been heard; THEREFORE BE IT RESOLVED, that the following department appropriations be changed as follows:

Moved by Johnson, seconded by Jordan, to approve repair work in Drainage Ditch #67 for Scott Warburton in Section #19 of Diamond Lake Township. The repair work should cost less than $1000. Roll call vote-Johnson-aye, Jordan-aye, Allen-aye, Fairchild-aye, and Leupold-aye.

Supervisor Allen presented the Board with two options concerning raising the present cost of health insurance premiums for county employees. The first option employees would pay a percentage of the risk factor if the risk increased. The second option, the employee would not contribute to the risk factor just the rate. Single policy holders will pay $6.45 a month and family will pay $188.24 per month, an increase of $10.24 a month. Moved by Allen, seconded by Jordan to choose Option 2 which increases the cost of health insurance for county employees for family plans by $10.24 for a total of $188.24 a month and for single plans will now pay $6.45 a month effective July 1st, 2017. Roll call vote-Allen-aye, Jordan-aye, Johnson-nay, Fairchild-aye, and Leupold-nay.

The board gave their weekly board and committee reports.

PUBLIC HEARING

The Wahpeton Board of Adjustment will conduct a public hearing on Thursday, June 15th 2017

at 5:00 p.m. in the Wahpeton City Hall to consider the following:

- A construction permit request for Jeff Henry and family of 2416 Manhattan Blvd, Milford IA. They are requesting a variance for a detached garage to be 30’x32’ which would be 960 square feet. Current accessory buildings including detached garages: 165.11.8: 720 square feet this would be a 30’x24’ garage.

- A construction permit request for Crescent Beach Properties LLC of 1620 Lakeshore Drive, Milford IA. They are requesting a variance to add decks to the south side of the property they just purchased. This property currently does not meet the Commercial District setbacks of 165.06.5. They are requesting the variance for the decks of 16’x18’ and 12’x19’6” of access to the property for guests.

- A construction permit request for Lolis Development LLC of 2516 Manhattan Blvd, Milford IA. They are requesting a variance to construct three wood porches (decks) attached to the structure. One being at the Entrance to the main building of 8’x14’ proposed deck, one being at the lakeside area of the main building of 5’x8’ proposed deck. The third proposed deck of 10’x12’ to be on the detached garage/guest house. The current property does not meet the Lakeshore District setbacks of: 165.05.5 this is a non-conforming property.

The Okoboji Community School Board of Education met for a Special Session to approve new hires and ratify tentative agreement on May 25, 2017 in the Conference Room of the District Administrative Office at 7:00 a.m. Members present: Titterington, Hansen, Weaver, Nielsen; Absent: Dodge; Secretary: Sporrer. PUBLIC HEARING NOTICE

Public notice is hereby given that the Board of Adjustment for the City of Okoboji, Iowa will conduct a public hearing on June 14th, 2017 at 6:00 P.M. in the Okoboji City Hall to consider a variance request and/or appeal zoning administrator decision by Okoboji Commons Hotel, LLC and to formalize conditional use permit for an outdoor service area located at Lot 5 Village Oaks & former Road ROW commonly known as 1302 Highway 71 North, Okoboji, Iowa.

Okoboji Commons Hotel, LLC are requesting to place a small structure, not on a foundation, on the property as an accessory building. The small structure proposed would be 132 square feet. Article XI Section 11.12 (3) states that small structures are exempt from obtaining a construction permit. Zoning administrator has determined the structure proposed would not qualify as small structure and the structure constitutes a non-conformity. Non-conformities are not allowed as defined in Article XIV General Regulations. This non-conformity precludes the proposed structure as presented. The Okoboji Commons Hotel sought and was granted by the City Council for an outdoor service area for the sale of liquor in June of 2016. The formal process to grant an outdoor service area as required by Article VIII was not fully completed at this time. This public hearing will be held to formalize a conditional use permit as required by Article VIII and Article XVIII. In addition at this time, Okoboji Commons Hotel would like to add an additional outdoor service area for a proposed small structure to serve coffee to their guests.

Any party of interest may appear in person or by legal counsel to express their views either in support of or against the granting of the variance. Written comments shall be delivered to the office of the City Clerk not later than 4:00 P.M. on the above date.

Notice is hereby given that on the third Monday of June, to wit, the 19th of June, 2017, in the Community Room located on the first floor of the Dickinson County Courthouse, Suite 1510, 1802 Hill Avenue in Spirit Lake, Dickinson County, Iowa, the following described list of lands, town lots and mobile home taxes will be offered for public sale until all parcels’ taxes are sold. Buildings on leased land will not be offered at this sale. Delinquent taxes for buildings on leased lands will be collected as directed in Section 445.3 of the Code of Iowa.

The tax sale will begin at 9:00 a.m. on June 19, 2017, and continue until all parcels are presented for sale. When the real estate advertised for sale has been offered and a part remains unsold for want of bidders, the treasurer will adjourn the sale to a future date not exceeding two months from adjournment. Due notice of the future date will be given at the time thereof.

Notice is hereby given that all real estate which remains liable for delinquent taxes and has been previously advertised and offered for sale one year or more and remains unsold for want of bidders is also offered and sold at the public auction to bidders at said time and place. Parcels marked with an * have been advertised for two years and are eligible for public bidder tax sale which will immediately follow the regular tax sale on June 19, 2017.
