9:30 A.M. Present are Supervisors Paul Johnson, Mardi Allen, Vice-Chairperson Pam Jordan and Chairperson William Leupold. Supervisor Tim Fairchild was absent.

The Pledge of Allegiance was recited by those present.

Meeting called to order by Chairperson, William Leupold.

Moved by Allen, seconded by Johnson, to approve the March 21, 2017 Board Meeting Minutes as amended. Roll call vote: Allen-aye, Johnson-aye, Jordan-aye, and Leupold-aye.

Moved by Allen, seconded by Jordan, to approve the Fireworks Display Permit for Tal Allen, d/b/a J and M Displays, Inc. The display will be discharged on Big Spirit Lake, on July 3, 2017, with a rain date of July 7 or July 8, 2017. Roll call vote: Allen-aye, Jordan-aye, Johnson-aye, and Leupold-aye.

Iowa Department of Natural Resources to be covered under the NPDES General Permit No. 2 “Storm Water Discharge Associated with Industrial Activity for Construction Activities”.

The storm water discharge will be from Excavation, Site Grading and Paving

Located in the Northwest ¼ and the Southwest ¼ of Section 20, Township 99 North, Range 36 West of the 5th P.M., City of Okoboji, Dickinson County, Iowa

Storm water will be discharged from two point sources and will follow the overland runoff path into the storm sewer system and into East Lake Okoboji.

To all persons interested in the estate of Theodore R. Limke, Deceased, who died on or about March 26, 2017:

You are hereby notified that on March 29 2017, the Last Will and Testament of Theodore R. Limke, deceased, bearing the date of April 16, 2010 was admitted to probate in the above named court and that Ronald J. Shea was appointed Executor of the estate. Any action to set aside the will must be brought in the District Court of the above county within the later to occur of four months from the date of the second publication of this Notice or one month from the date of mailing of this Notice to the surviving spouse and all heirs of the Decedent and devisees under the Will whose identities are reasonably ascertainable, or thereafter be forever barred.

Notice is further given that all persons indebted to the estate are requested to make immediate payment to the undersigned, and creditors having claims against the estate shall file them with the Clerk of the above named District Court, as provided by law, duly authenticated, for allowance, and unless so filed by the later to occur of four months from the second publication of this Notice or one month from the date of mailing of this Notice (unless otherwise allowed or paid) a claim is thereafter forever barred.

Dickinson County Board of Supervisors

March 21, 2017

9:30 A.M. Present are Supervisors Paul Johnson, Mardi Allen, Tim Fairchild, Pam Jordan Vice-Chairperson and Chairperson Bill Leupold.

The pledge of allegiance to the flag was recited by those present.

9:30 A.M. Time for the Public Hearing on the proposed improvements and establishment of drainage District #92. Many land owners from within the proposed drainage ditch were in attendance. Chairman Leupold opened the Public Hearing. Rick Hopper, Engineer with Jacobson-Westergard, & Assoc. presented an overview of the preliminary engineering report. The drainage in the proposed district is now provided by surface flow to an existing waterway; thus, the drainage is quite inadequate. Hopper also explained that Iowa Code Chapter 455A, Section 468.28 allows for Dismissal on Remonstrance. Remonstrance is met when a majority of the landowners, owning 70% of the land in the proposed area, petition against the establishment. The landowners have met the remonstrance requirements. Leupold asked for public comment. There being no further comments, Chair Leupold closed the public hearing. As the landowners met the requirements of remonstrance, moved by Johnson, seconded by Fairchild to deny the establishment of the proposed drainage ditch #92. Roll call vote: Johnson-aye, Fairchild-aye, Allen-aye, Jordan-aye, Leupold-aye. .

Moved by Allen, seconded by Fairchild, to pay Estimate No. 1 for tree cleaning in the amount of $38,587.50 to Cory Juergens Construction of Estherville, Iowa for Joint Drainage District No. 61. Roll call vote: Allen-aye, Fairchild-aye, Johnson-aye, Jordan-aye, Leupold-aye. Rick Hopper, Jacobson Westergard engineer, reported that he had applied and received a permit from the Army Corp of Engineers to have the drainage ditch extend to Trumble Lake but that the Iowa DNR had not approved their permit. The Army Corp of Engineers then withdrew their permit. On advice from Lonnie Saunders, assistant county attorney, Hopper will reapply for the permits.

Moved by Jordan, seconded by Allen, to approve the March 14, 2017 board minutes as presented. Roll call vote: Jordan-aye, Allen-aye, Johnson-aye, Fairchild-aye, Leupold-aye.

Moved by Jordan, seconded by Johnson, to approve the appointment of Timothy O’Hagan to the Board of Health to fill the vacancy left by the resignation of Dr. Donald Rodawig. Roll call vote: Jordan-aye, Johnson-aye, Allen-aye Fairchild-aye, Leupold-aye.

Grounds Director Clark Reekers present. Reekers informed the Board that he was planning on fixing the bricks around the courthouse tower before Memorial Day of this year instead of waiting until next year at the cost of approximately $1000.

County Engineer Dan Eckert present. Moved by Allen, seconded by Fairchild, to approve the plans for Project Number L-617-73-30 which is also known as the old Highway #71 bridge replacement (Simington Bridge) with a culvert project in Section 19 of Milford Township. The bid letting date is set for April 18, 207 at 10”00 A.M. Roll call vote: Allen-aye, Fairchild-aye, Johnson-aye, Jordan-aye, Leupold-aye.

The board gave their week weekly board and committee reports.

There being no further business presented to the board, it was moved by Fairchild, seconded by Allen, to adjourn. Roll call vote: Fairchild-aye, Allen-aye, Johnson-aye, Jordan-aye, Leupold-aye. Meeting adjourned at 10:44 A.M.

NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF SPIRIT LAKE, STATE OF IOWA, ON THE MATTER OF THE PROPOSED AUTHORIZATION OF A LOAN AGREEMENT AND THE ISSUANCE OF NOT TO EXCEED $9,500,000 GENERAL OBLIGATION REFUNDING CAPITAL LOAN NOTES OF THE CITY (FOR ESSENTIAL CORPORATE PURPOSES), AND THE HEARING ON THE ISSUANCE THEREOF

PUBLIC NOTICE is hereby given that the City Council of the City of Spirit Lake, State of Iowa, will hold a public hearing on the 25th day of April, 2017, at 5:30 P.M., in the Council Chambers, City Hall, 1803 Hill Avenue, Spirit Lake, Iowa, at which meeting the Council proposes to take additional action for the authorization of a Loan Agreement and the issuance of not to exceed $9,500,000 General Obligation Refunding Capital Loan Notes, for essential corporate purposes, to provide funds to pay the costs of aiding in the planning, undertaking and carrying out of urban renewal projects, including the current refunding of the City’s outstanding General Obligation Urban Renewal Annual Appropriation Refunding Bonds dated July 26, 2012 and the City’s outstanding General Obligation Urban Renewal Refunding Bonds, dated August 28, 2012. Principal and interest on the proposed Loan Agreement will be payable from the Debt Service Fund.

At any time before the date of the meeting, a petition, asking that the question of issuing such Notes be submitted to the legal voters of the City, may be filed with the Clerk of the City in the manner provided by Section 362.4 of the Code of Iowa, pursuant to the provisions of Sections 384.24(3)(q), 384.24A, 384.25 and 403.12 of the Code of Iowa.

At the above meeting the Council shall receive oral or written objections from any resident or property owner of the City to the above action. After all objections have been received and considered, the Council will at the meeting or at any adjournment thereof, take additional action for the authorization of a Loan Agreement and the issuance of the Notes to evidence the obligation of the City thereunder or will abandon the proposal to issue said Notes.

This notice is given by order of the City Council of the City of Spirit Lake, State of Iowa, as provided by Chapters 384 and 403 of the Code of Iowa.

REGULAR MEETING OF THE BOARD OF TRUSTEES OF

THE IOWA GREAT LAKES SANITARY DISTRICT

March 28, 2017 3:00 P.M.

DISTRICT OFFICE, MILFORD, IOWA

President Boettcher called the meeting to order at 3:00 p.m.; trustees Bailey, Senn, Rohlfsen and Hoppe were present. Mike Roth called in to cover engineering items.

Denied Partial Payment Application #4 and #5 for Project 2014-1 Section B based on the General Conditions Article 14.02.A.2, Article Section 14.02.D.1 and due to the amount of liquidated damages against the contractor will exceed the balance budget for the project. (Rohlfsen/Hoppe); all aye.

Roth covered the costs for alternates to go to the Little Sioux River and a draft of the Nutrient Reduction costs for the plant to meet the current permit requirements. Roth took comments and will return with the final draft of the nutrient study.

Anderson and Roth discussed the ongoing issues with MPT and Merchants Bond Company. Trustees wanted to find out if there is a state board that oversees bond companies.

Anderson reported that the South Center Lake Study is completed and should be ready for the meeting next month. Also that work continues with North Templar Park Association with infiltration issues.
