REGULAR MEETING OF THE BOARD OF TRUSTEES OF

THE IOWA GREAT LAKES SANITARY DISTRICT

February 28, 2017 3:00 P.M.

President Boettcher called the meeting to order at 3:00 p.m.; trustee Hoppe, Bailey and Senn were present.

The president declared this was the time and place for a public hearing for the IGLSD Fiscal Year 2018 budget. The President asked the Clerk for any written comments, there were none. The President asked for any oral comments, there were none. With no comments the President closed the public hearing.

Hoppe moved to approve the Fiscal Year 2018 budget with a levy rate of $2.5001 per $1,000 of evaluation. Senn seconded the motion, all aye; motion passed.

Trustees approved an amendment for the Profession Service Agreement with HR Green for the PLC Upgrade design work for a total of $20,000. (Bailey/Senn); all ayes. This amendment was to bring John Olson into the design and planning work.

Trustees denied a request to abate past due sewer fees or taxes for the property at 903 Okoboji Avenue, Milford, IA (Senn/Hoppe); all ayes.

Trustees moved and approved the change life insurance policies from Dearborn National to New York Life (Bailey/Hoppe); all ayes.

Trustees approved the renewal of agreement for the SHIELD safety program with Northwest Iowa Planning and Development Commission (Senn/Hoppe); all ayes.

Anderson updated Trustees on work by Municipal Pipe and Tool and meeting for relocation of sewer on Lakeshore Drive.

The meeting was adjourned motion (Bailey/Boettcher).

Presiding: Kevin Bice, called the meeting to order.

New Compost Update: A discussion was on the possibility of allowing fish waste to be mixed into the compost. Lee Sorenson informed that he had been in contact with Bryon Whiting of the Iowa Department of Natural Resources about the issue, at this time Bryon was still researching the topic. There was no action taken and will gather information from IDNR.

Agenda: Motion approving the agenda. Tielbur/ Ballis. All ayes.

Minutes: Motion approving the minutes from the January 26t, 2017 meeting Ballis/Maas. All ayes.

Treasurer’s report: No report was presented this month; Wanda will provide a report at the next meeting.

Outstanding bills: No bills were presented at the meeting.

Operations: Charles Vigdal, provided an update about the landscape waste and white goods. Some traffic is coming in with lawn waste but with the warm temperatures it is pretty muddy.

Landfill Update: NO one was in attendance from the landfill, no update was provided.

Terril City Council Meeting

March 6, 2017

The Terril City Council met in regular session on March 6, 2017 at 6:00 PM at Terril City Hall. The meeting was called to order at 6:00 P.M. by Mayor Pro-Tem Julie Thiesen. The following councilpersons were present: Brian Brawner, Jeri Nissen, Ron Soat, Ken Trojahn. Absent: Darrell Woods Jr. Others present: Tim Matthews, and Dana Loring.

Unless otherwise indicated, all of the motions offered at this meeting were carried with the following vote:  Ayes: Brawner, Nissen, Soat, Trojahn. Nays: None.  Abstentions: None

Motion by Soat and seconded by Nissen to approve the agenda. Aye: Nissen, Soat, Trojahn. Nay: None. Motion Carried. Brian Brawner arrives at 6:08 pm.

Jeri Nissen addressed the council regarding the possibility of Pro Coop purchasing approximately 3 acres of land from the city to be used as a bin site.

Motion by Nissen and seconded by Trojahn to approve the minutes of the February 6, 2017 meeting as presented. Motion carried.

Motion by Soat and seconded by Trojahn to approve the claims of the city as presented. Motion Carried.

Motion by Nissen and seconded by Soat to approve the Treasurer’s Report. Motion carried. February receipts totaled $31,180.40 and February disbursements totaled $35,007.82.

Motion by Soat and seconded by Nissen to approve Resolution 2017-04, Funds Transfer Resolution. Motion Carried.

Mayor Pro-Tem Thiesen opened the FY 2018 Budget Public Hearing. Following discussion, the Mayor Pro-Tem closed the public hearing. Motion by Soat and seconded by Brawner to approve Resolution 2017 -05, FY 2018 Budget. Motion carried.

Motion by Brawner and seconded by Nissen to approve Resolution 2017-06, Salary Resolution effective July 1, 2017. Motion carried.

The council reviewed building valuations.

Motion by Brawner and seconded by Trojahn to approve Outdoor Service Area for the Main Street Bar for an April 1, 2017 dart tournament. Motion carried.

After discussion, motion by Brawner and seconded by Nissen to approve 6 –year service agreement (2017 through 2022) for the city water tower with Maguire Iron at a cost of $14,760 per year. Aye: Brawner, Nissen, Trojahn. Nay: Soat. Motion carried.

The City Council and Planning & Zoning Board will begin to review and update the Terril Zoning Ordinance on Monday, March 27 at 5:30 pm at the Terril Memorial Building.

The April regular City Council meeting will be held Monday, April 3, 2017, at 6 PM at Terril City Hall.

The Spirit Lake Community School Board of Directors met in special session on March 8, at 12:00 p.m. in the District Office Board Room at 2701 Hill Avenue. Present were board members Teresa Beck, Keith Brockmeyer, Sonja Hamm and Scott Trautman. Absent was Todd Hummel. Also present were David Smith-Superintendent, Donna Sebert-Board Secretary, Karen Oleson-Director of Business & Finance, 5 staff members and 1 visitor.

Vice President Teresa Beck called the meeting to order, the Pledge of Allegiance was recited.

Trautman/Hamm moved/seconded approval of the agenda. All aye vote. Motion carried.

Trautman/Brockmeyer moved/seconded approval of reopening the early retirement incentive program using the tiered incentive option as previously approved to be offered March 8, 2017 and returned by March 20, 2017. The first 3 applications received will be submitted to the board for approval. All aye vote. Motion carried.

PUBLIC NOTICE OF INTENT TO CONSIDER ISSUANCE OF SECTION 401 WATER QUALITY CERTIFICATION

The Iowa Department of Natural Resources (IDNR) proposes to evaluate Section 401 Certification for the following project. The Section 401 Certification is the statement that a project will not cause a violation of Iowa’s Water Quality Standards.

PROJECT DESCRIPTION: The City of Orleans proposes to upgrade a boat ramp to provide public access to Sunset Park on Big Spirit Lake in S27, T100N, R36W, in Dickinson County. Project application material may be requested by calling Chris Schwake at (515) 725-8399. Anyone wishing to comment on the intent to proceed with Section 401 Certification review must do so in writing by March 30, 2017 (send to IDNR, Chris Schwake, Wallace State Office Building, Des Moines, IA 50319-0034). All relevant comments will be considered in the review process.

Board Meeting March 6, 2017

The Milford Municipal Utilities Board of Trustees met in regular session on Monday, March 6. 2017 at 6:15 P.M. in the Board Room. In attendance were Board Members Mike Anderson, Wanda Nelson, Sue Prunty and Kevin Wharton (entered the meeting at 6:38); Manager Eric Stoll; Secretary Paula Nordblad; Utility Attorney Abby Walleck; Guest City Administrator LeAnn Houge. Chairman Wurtz was absent.

Vice Chairman Nelson called the meeting to order.

The agenda was approved with a request to move the approval of bills after discussion of the City of Milford’s pay request. Secretary Nordblad noted that the June 30, 2017 budget may need to be amended because of the increase in power cost due to Neal #4 not running. Vice-chairman Nelson announced that this is the time for the public hearing on the Electric and Water Budget for the Year Ending June 30, 2018. The Secretary noted that the office did not receive any comments. There were no further comments. Nelson closed the public hearing.

City Administrator Houge noted that the City Council is moving ahead with replacement of the base covers on the street lights on highway 71 and requested a 50% cost share with the Utilities. The quote for materials is $19760. Manager Stoll noted that this is not in the 2017 or 2018 Utility budget. The City Administrator stated that the City has $80,000 in the budget for 2017 Anderson stated that in the past the Utilities did not pay for and do not own street lighting but have provided labor for installation. Manager Stoll stated that MMU can provide staff to install the covers. The request was tabled until the April meeting when all Board Members were present.

The City Administrator requested that the Utility Board abate the lien placed on 903 Okoboji Ave as the City has a buyer for the property. The Board declined the request.

Staff reported that the City has requested payment of $60,073 for the additional block on H Ave. The City Administrator was asked if the Engineer had guaranteed payment of any potential fine for lack of permit on the water portion of the project and she said she has not gotten a guarantee from him. Anderson/Prunty made a motion to hold a $5,000 retainage pending the results of any fines from the IDNR and make payment of $55,073 to the City and we will discuss payment of the retainage once we have heard from the IDNR. Motion passed unanimously.

Prunty/Anderson made a motion to approve Resolution 03-17, A Resolution Adopting the Annual Budget for the Fiscal Year ending June 30, 2018. A roll call vote was taken. Ayes – Wharton, Prunty, Nelson, Anderson. Nays-none. Absent-Wurtz. Motion passed.

Staff reviewed the Cash Reserve Policy and the current reserves. We are making progress. Manager Stoll noted that Neal #4 not running is impacting our power costs and NIMECA is looking at an opportunity to purchase some wind generation.

Anderson/Prunty made a motion to approve Resolution 04-17, Adopting an Electric Avoided Cost. The rate will be $.02028. A Roll call vote was taken. Ayes – Wharton, Prunty, Nelson, Anderson. Nays – none. Absent – Wurtz. Motion passed.

Prunty/Wharton made a motion to approve the quote from R & D Industries for $2602.05 to replace the UPS on the servers. This will be shared with the City. Motion passed unanimously.

The City Administrator asked to give the Board an update on their current infrastructure plans. They are planning to finish H Avenue and work on P Avenue before they can do 13th St. 13th Street is tentatively planned for 2023 and will be working on grants for the project in the near future. The water portion of the project to finish H Ave is approximately $165,000. The City Administrator excused herself.

Anderson/Wharton made a motion to go into closed session to discuss litigation pursuant to Iowa Code Section 21.5(c). Motion passed unanimously. Those present going into closed session were Board Members Wharton, Prunty, Nelson, Anderson, Manager Stoll, Attorney Walleck and Secretary Nordblad. Those present coming out of closed session were the same.

Items discussed in the Manager’s Report:

• The Manager reported that we have 3-4 services that are leaking in the Country Meadows area. The developers in this area used black plastic water lines. Some of these customers have repaired their lines once already. We usually allow them to repair once, then replace if found to leak a second time. We may need to adopt a policy that they have to replace it the first time in this area. The Manager would like to re-visit offering water line insurance.

The Board of Trustees adjourned the meeting. The next regular meeting of the Milford Municipal Utilities Board of Trustees will be April 10, 2017.

Article #3 Definitions/Use Classifications, Section 1 Definitions, to change the definition requirement for Recreational Storage wording to as follows.

Recreational Storage: The renting of open or enclosed space of storage of recreational vehicles, snowmobiles, all-terrain vehicles, motorcycles, boats, trailers, hoists and other marine sporting equipment owned by individuals other than the property owner or occupant of the premises.

Article #3 Definitions/Use Classifications, Section 1 Definitions, to change the definition requirement for Yard, Front to as follows:

Yard, Front: A yard extending across the full width of the lot and measured between the front lot line and the building or any projection thereof, other than the projection of cornices and eaves which project two (2) feet or less from the building. Where the roadway is existing by easement, the front line is the right-of-way line.

To change the wording to: two (2) feet or less from the building.

Article #3 Definitions/Use Classifications, Section 1 Definitions, to change the definition requirement for Yard, Rear to as follows:

Yard, Rear: a yard extending across the full width of the lot and measured between the rear lot line and the structure or any projections other than cornices and eaves which extend two (2) feet or less from the building. On both corner lots and interior lots, the opposite end of the lot from the front yard shall be considered the rear yard.

To change the wording to: two (2) feet or less from the building

Article #3 Definitions/Use Classifications, Section 1 Definitions, to change the definition requirement for Yard, Side to as follows:

Yard, Side: The required open space, unobstructed to the sky, extending from the front yard to the rear yard and measured between the side lot line and the nearest building, excluding only cornices and eaves which project two (2) feet or less from the building.

Article #3 Definitions/Use Classifications, Section 1 Definitions, to add the definition for Solar Panels to the Zoning ordinance.

Solar Panels: A device utilizing the sun’s rays to produce heat or electricity. If the panels are attached to the principal structure, then they become part of the principal structure. If the panels are a stand-alone structure, then they are considered an accessory structure.

These amendments were approved by the Board of Supervisors on July 26, 2016.

These amendments shall be in effect after passage, approval and publication as provided by law.
