You are hereby notified that there is a petition on file in the office of the clerk of the above court which petition prays for a judgment in rem against the property involved in this action for the sum of $41,141.34 with interest at 5.25% per annum from and including August 1, 2015, on the promissory note executed by Sharon H. Maras, a single person and mortgage executed by Sharon H. Maras, a single person to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, its successors and assigns and assigned to Plaintiff, who is the sole and absolute owner thereof.

Said note, together with the mortgage given to secure the same are due and payable by reason of the failure of the Defendants Sharon H. Maras, a single person to pay the installments of principal when due. Plaintiff also prays in said Petition for the foreclosure of said mortgage dated September 26, 2008 recorded in Document 08-05754Book 374 Page 225 in the Recorder’s Office of Dickinson County, Iowa, with said note dated September 26, 2008 on the following described property, to-wit:

Lots Twelve (12) and Thirteen (13) in Block Seven (7) of Hurd`s First Addition to the Town of Superior, Dickinson County, Iowa

and also asking that said mortgage be declared a prior and superior lien to that of each of the above named Defendants; for appointment of a receiver; for the amount paid by Plaintiff for attorneys’ fees, abstract expense, costs and accruing costs of this action; that special execution issue for the sale of said real estate to satisfy said judgment, interest, attorneys’ fees and costs and for such other and further relief as may be just and equitable.

Moved by, seconded by, to approve Resolution 2021-21-County approval of City of Milford use of future incremental property tax revenues in Nature Trails Urban Renewal Area for a total period of up to sixteen fiscal years. WHEREAS, the City of Milford, Iowa (the “City”) has established the Milford Nature Trails Urban Renewal Area and will establish the Milford Nature Trails Urban Renewal Area No. 2 (collectively, the “Urban Renewal Areas”), pursuant to Chapter 403 of the Code of Iowa to include the real property described on Exhibit A hereto (the “Property”); and WHEREAS, project development needs with respect to the Property will require that the City use incremental property tax revenues, as provided for in Section 403.19 of the code of Iowa, received with respect to the Property to pay the costs of certain public improvements related to the development of a housing subdivision in the Urban Renewal Areas (the “Project”); and WHEREAS, Section 403.22 of the Code of Iowa prohibits cities from collecting incremental property tax revenues for this type of project for more than eleven years without the express consent of any affected county, school district and community college; and WHEREAS, the City and developer of the Property have requested that the Board of Supervisors of Dickinson County, Iowa approve this resolution in order to allow the City to use incremental property tax revenues from the Property for five additional fiscal years, as provided by law; NOW, THEREFORE, it is resolved by the Board of Supervisors of Dickinson County, Iowa, as follows: Section 1.Pursuant to Section 403.22 of the Code of Iowa, this Board hereby approves the use by the City of Milford, Iowa, of future incremental property tax revenues produced with respect to the Property, for a total period of up to sixteen fiscal years. Section 2. The County Auditor is hereby directed to forward an executed copy of this Resolution to the office of the City Administrator for the City of Milford. PUBLIC NOTICE OF INTENT TO CONSIDER ISSUANCE OF SECTION 401 WATER QUALITY CERTIFICATION

The Iowa Department of Natural Resources (IDNR) proposes to evaluate Section 401 Certification for the following project. The Section 401 Certification is the statement that a project will not cause a violation of Iowa’s Water Quality Standards.

PROJECT DESCRIPTION:  The Bayrym Homeowner’s Association proposes to install an underground 8” PVC pipe and tie in sump pumps and downspouts directing water to West Okoboji Lake in S12, T99N, R37W, in Dickinson County. This drainage system will allow rain and groundwater to enter the lake while preventing erosion in the future. Project application material may be requested by calling Chris Schwake at (515) 725-8399. Anyone wishing to comment on the intent to proceed with Section 401 Certification review must do so in writing by December 1, 2016 (send to IDNR, Chris Schwake, Wallace State Office Building, Des Moines, IA 50319-0034). All relevant comments will be considered in the review process.

PUBLIC COMMENTS

Terry Sheller, 513 38th Street, expressed concern of the poor condition of the boulevards in Southern Glenn. City Administrator Gregg Owens explained the Street Committee will be meeting to discuss the boulevards in Southern Glenn and stated the City will be mailing a letter to the homeowners and property owners of Southern Glenn to get their input as to what they would like to see done to the boulevards.

Manager Stoll and Don Brueker presented a Section 457(b) retirement plan and explained how this plan works and the organizations involved in the administration. This is an employee funded plan. He requested that the board approve the plan to encourage employees to save for retirement and to pay for the initial set up fee of $950, the monthly fee for plan compliance of $3 per month per participant and the annual recordkeeping fee of $40 per participant. The participants would then be responsible for the annual custodial fee of .15% of assets and the annual financial advisor fee of 1.5% of assets. They noted that they had looked at several plans with higher fees before choosing this one to present. Wharton/Nelson made a motion to approve adding the plan to the employee benefits and to pay the fees as noted. Ayes-Wharton, Prunty, Nelson and Wurtz. Nay-Anderson. Motion passed.

Prunty/Anderson made a motion to approve Resolution 11-16, Adopting a Rate for Light Pole Rental. Roll call vote was taken. Ayes-Wharton, Prunty, Nelson, Anderson and Wurtz. Nays-none. Motion passed unanimously. Attorney Walleck noted that we should have a rental agreement which sets the policy regarding who is responsible if the pole is damaged.

Nelson/Prunty made a motion to approve the Engineering quote from Bolton & Menk, Inc for $15,000 for the 230th Ave Waterline Project. Motion passed unanimously.

Manager Stoll presented the 2017 Health Insurance Quote and noted that there is a 13% increase. Staff presented various options to the current policy. Wharton/Prunty made a motion to keep the current plan and revisit the same in the next year and discuss the employee premium contribution next month’s meeting in conjunction with wage reviews. Motion passed unanimously.

The date for the Employee Appreciation Party was set for December 7th at the Coffee Shop.

Items discussed in the Manager’s Report:

• Manager Stoll presented average cost per kwh in Iowa. We are very competitive. Eric asked the board what they think about having renewables in the portfolio vs cost associated with them. It was noted that most of our customers will want the cheapest energy. With the decrease in production at the coal plant, we may need another source. If the wind is not blowing and coal plants are decreased, they could call for us to run the engines and we may want another engine down the road.

• Manager Stoll has been meeting with the manager of Iowa Lakes Regional Water and they are negotiating terms of a new contract. When the contract is more firmed up, the same will be presented to the Board for review and discussion. This contract could be a model that could be used with other consecutives.

• Manager Stoll gave the Board an update regarding the properties being considered for the Solar project.

The Board of Trustees adjourned the meeting. The next regular meeting of the Milford Municipal Utilities Board of Trustees will be December 5, 2016.

NOTICE OF FINAL SPECIAL ASSESSMENT SCHEDULE

The following final special assessment schedule was adopted by the Spirit Lake City Council pursuant to Iowa Code section 384.60 for the following property.

Lot 6, Block 55 Newcomer’s Addition to the City of Spirit Lake, Dickinson County Iowa.

Parcel No. 07-04-214-002, located at 1405 Gary Avenue, Spirit Lake, Iowa.

The amount of the assessment is $18,000.00. The assessment shall be paid in 15 consecutive annual installments of $1,200.00. The first installment is due July 1, 2017 and subsequent installments are due on the 1st day of July each year. Interest on unpaid installments shall accrue at the rate of 9% per year.

Assessments may be paid in full or in part without interest within 30 days after the date of the first notice of the final assessment schedule, and thereafter all unpaid special assessments shall bear interest at the rate of 9% per year, but not exceeding that permitted by chapter 74A, computed to the December 1 next following the due dates of respective installments as provided in section 384.65, subsection 3, and each installment will be delinquent from October 1 following its due date, unless the last day of September is a Saturday or Sunday, then that amount shall be delinquent from the second business day of October. Delinquent installments will draw the same delinquent interest as ordinary taxes, and property owners may elect to pay any installment semiannually in advance.

Ordinance No. 10-12-16

An Ordinance Deleting Property From the Tax Increment Financing District for the Nature Trails Urban Renewal Area of the City of Milford, Iowa, Pursuant to Section 403.19 of the Code of Iowa

WHEREAS, the City of Council of the City of Milford, IA ( the “City”) previously enacted an ordinance providing for the division of taxes levied on taxable property in the nature Trails Urban Renewal Area pursuant to Section 403.19 of the Code of Iowa’ and

WHEREAS, pursuant to that ordinance, a portion of the Nature Trails Urban Renewal Area in the City of Milford was designated a “tax increment district”, and

WHEREAS, the City Council now desires to decrease the size of the “tax increment district” by deleting certain property;

BE IT ENACTED by the City Council of the City of Milford, Iowa:

Section 1. Purpose. The purpose of this ordinance is to delete certain property from the tax increment financing district for the Nature Trails Urban Renewal Area.

Section 2. Definitions. For use within this ordinance the following terms shall have the following meanings:

“Deleted Property” shall mean the following described real property situated in the City of Milford, County of Dickinson, State of Iowa:

Lot 57, Plat of Nature Trails Phase II, DCI

Lots 59 thru Lot 107, Plat of Nature Trails Phase II, DCI

Lot 109, Plat of Nature Trails Phase II, DCI

Lot 110, Plat of Nature Trails Phase II, DCI

Section 3. The Deleted Property is hereby removed from the tax increment financing district for the Nature Trails Urban Renewal Area. No division of property tax revenues as provided under Section 403.19 of the Code of Iowa shall be done with respect to the Deleted Property without further action by the City Council.

Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 5. Saving Clause. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

Section 6. Effective Date. This ordinance shall be effective after its final passage, approval and publication as provided by law.
