You are hereby notified that there is a petition on file in the office of the clerk of the above court which petition prays for a judgment in rem against the property involved in this action for the sum of $41,141.34 with interest at 5.25% per annum from and including August 1, 2015, on the promissory note executed by Sharon H. Maras, a single person and mortgage executed by Sharon H. Maras, a single person to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, its successors and assigns and assigned to Plaintiff, who is the sole and absolute owner thereof.

Said note, together with the mortgage given to secure the same are due and payable by reason of the failure of the Defendants Sharon H. Maras, a single person to pay the installments of principal when due. Plaintiff also prays in said Petition for the foreclosure of said mortgage dated September 26, 2008 recorded in Document 08-05754Book 374 Page 225 in the Recorder’s Office of Dickinson County, Iowa, with said note dated September 26, 2008 on the following described property, to-wit:

Lots Twelve (12) and Thirteen (13) in Block Seven (7) of Hurd`s First Addition to the Town of Superior, Dickinson County, Iowa

and also asking that said mortgage be declared a prior and superior lien to that of each of the above named Defendants; for appointment of a receiver; for the amount paid by Plaintiff for attorneys’ fees, abstract expense, costs and accruing costs of this action; that special execution issue for the sale of said real estate to satisfy said judgment, interest, attorneys’ fees and costs and for such other and further relief as may be just and equitable.

9:30 A.M. A.M. Present are Supervisors Paul Johnson, Mardi Allen, Sara Koepp, Vice-Chairperson Pam Jordan, and Chairperson William Leupold.

The Pledge of Allegiance was recited by those present.

Meeting called to order by Chairperson, William Leupold.

The Dickinson, Clay, and Emmet County Board of Supervisors met as trustees of Joint Drainage District #61 C, D, & E at 9:30 A.M. for the purpose of a bid letting and opening of submitted bids for the Main Open Ditch Cleanout in Joint 61, C, D, &E.

Leupold asked for a roll call of those present:

Dickinson: Supervisor’s Paul Johnson, Mardi Allen, Pam Jordan, Sara Koepp, William Leupold, and Auditor Lori Pedersen.

Clay: Supervisor’s Barry Anderson, Linda Swanson, Delmar Brockshus, Burlin Matthews, Joe Skow, and Auditor Marjorie Pitts (all telephonically).

Emmet: Supervisor’s Tim Schumacher, Beverly Juhl, Alan Madden, John Pluth, Jeff Quastad, and Assistant Auditor Colleen Anderson (all telephonically).

It was moved Clay County Supervisor Burlin Matthews, seconded by Clay County Supervisor Linda Swanson to appoint Dickinson County Supervisor William Leupold as Chairperson for the meeting. All voted aye. It was moved by Dickinson County Supervisor Mardi Allen, seconded Emmet County Supervisor Beverly Juhl, to appoint Dickinson County Auditor Lori Pedersen as secretary for the meeting. All voted aye.

Rick Hopper from Jacobson-Westergard & Associates present. Hopper informed the joint boards that 18 plan holders had picked up specification packets, and 6 formal bids had been received. The engineer’s estimate for the project was $468,549. Hopper proceeded to open the submitted bids and check that 10% Bond Security was included. Bids were received from the following:

As there were no further items presented to the joint boards, it was moved by Dickinson County Supervisor Mardi Allen, seconded by Clay County Supervisor Barry Anderson, to adjourn. All voted aye.

Milford City Administrator LeAnn Houge, Milford Mayor Bill Reinsbach, and Kuch Builders, the Developers of Nature Trails, present requesting the county’s approval extending Nature Trails Phase I and Phase II an additional 5 years. The original plan was limited to 11 years without consent from the County, School, and Area College. Additionally, the original plan did not include a resolution that grants the 5-year extension. The current urban renewal plan is being amended. The resolution being requested to approve and adopt would incorporate both Phase I and Phase II of Nature Trails, and formally grant the additional 5-year extension. Houge, Reinsbach, and the Developers answered questions from the board. After further discussion, the board wishes to place the item on the agenda for November 1, 2016. Several board members are planning to attend the urban renewal plan discussion meeting in Milford this evening. aye, Leupold-aye. Passed and approved the 18th day of October, 2016. Supervisor Johnson and Rick Hopper updated the board regarding the drafted letter that has been proposed to be sent to State Officials, voicing Jt. Drainage District #1 D&O’s angst regarding the delay in wetland determinations, which in turn has caused a huge delay in the project from going forward. Johnson has recently been in contact with NRCS employee Mark Schutt. Schutt is hoping to get a wetlands determination answer from the State by the end of the week. If the county has not received this determination by end of week, the letter is proposed to be sent to State Officials after the Osceola and Dickinson County Board of Supervisors, and the Lake Park City Council have signed the letter.

Moved by Allen, seconded by Leupold, to approve a single phase 7200-volt primary cable for 156 feet along the north right-of-way of County Road M56 (256th Avenue), near the Tom Radcliffe property. The work will all be done in Section #23, Spirit Lake Township. Roll call vote: Allen-aye, Leupold-aye, Johnson-aye, Koepp-aye, Jordan-aye.

Public Hearing and

Special Council Meeting

October 27, 2016

The Orleans City Council met in special session Thursday, October 27, 2016 at Orleans City Hall. Mayor Bill Maas call the meeting to order at 5:12 p.m. Council present Kristine Hoss, Keith Ostrum, Benjamin Radcliffe and Terry Wilts. Eric Anderson absent for public hearing. Others present: Don Hemphill, and Durand Cook.

This was the time and place for a public hearing on the proposal to issue Industrial Development Revenue Bonds Camp Foster YMCA project Series 2016. Mayor Bill Maas asked for any oral or written comments. City Attorney Don Hemphill informed council that all paperwork looks in order and the disclaimer is included stating the City of Orleans has no financial obligation regarding the re-payment of the bonds. There being no other comments, Mayor Maas closed the public hearing at 5:14 p.m.

Radcliffe introduced RESOLUTION 16-08 RESOLUTION AUTHORIZING THE ISSUANCE, EXECUTION, DELIVERY AND SALE OF INDUSTRIAL DEVELOPMENT REVENUE BONDS CAMP FOSTER YMCA SERIES 2016 NOT TO EXCEED $2,500,000.00 and moved for its adoption. Ostrum seconded and in roll call vote, Hoss, Wilts, Radcliffe and Ostrum voted aye. Motion carried 4-0. Resolution 16-08 duly adopted.

Council member Eric Anderson arrived 5:20 p.m.

Council reviewed the proposed 2016 Orleans Zoning Ordinance language. Council agreed to clarify definitions of deck and patio, the definition of an impervious surface, make consistent the square footage requirements of site plans and no permits the same - less than 150 square feet. Council also agreed that section on exterior materials applicable to residences also be applicable to accessory buildings to maintain consistency.

AND LETTING

FILING OF SEALED BIDS

Sealed Bids will be received by the City Clerk of the City of Spirit Lake, Iowa (“OWNER”), at City Hall, 1803 Hill Avenue, Spirit Lake, IA 51360 until 2:00 p.m. CDST, on November 17, 2016, for the construction of the proposed Raw Water Improvements for said OWNER, as described in the project manual and drawings therefore on file in the office of the City Clerk of the City of Spirit Lake, Iowa. Bids will be publicly opened, read, and tabulated on the day and hour specified above, and will be acted upon by the OWNER at that time or at such later time and place as the OWNER may then determine.

PUBLIC HEARING

At 5:30 p.m. CDST, on November 22, 2016, a Public Hearing will be held at City Council Chambers on the proposed drawings, project manual, proposed Form of Contract (“Contract Documents”), and opinion of probable cost for the construction of said improvement. At said hearing any interested person may appear and file objections thereto.

GENERAL PROJECT DESCRIPTION

All Work, materials, and equipment are to be in accordance with the Contract Documents on file in the office of the City Administrator/City Attorney, and at the office of HR Green, Inc. (“ENGINEER”), 5525 Merle Hay Rd, Suite 200, Johnston, IA 50131, by this reference made a part hereof as though fully set out and incorporated herein.

The Work for the said improvement, as required by the Contract Documents, is generally described as follows:

Furnish all labor, materials, and equipment needed for the installation of approximately 1,300 feet of a new parallel 18-inch intake pipeline and screen into Big Spirit Lake, a new intake screen on the existing intake, installation of chemical feed and air backwash lines to the new screens, approximately 600 feet of new 16-inch raw water transmission main, approximately 550 feet of 4-inch sanitary forcemain relocation, demolition and new interior piping, associated electrical and control work, associated site work, and other miscellaneous work.

Work under the proposed Contract Documents shall be commenced upon written Notice to Proceed to be issued on or before December 20, 2016. Improvements to the new and existing intake lines shall be completed on or before a Milestone Date of June 16, 2017. The project shall be substantially completed and ready for operation on or before August 25, 2017, and shall be fully complete on or before September 29, 2017, subject to any extension of time, which may be granted by the OWNER.

The OWNER reserves the right to reject any or all Bids, to readvertise for Bids or to defer action on the Bids received for a period not to exceed 30 days from and after the date and time specified in this Notice of Hearing and Letting for receiving said Bids, and to waive irregularities and informalities.

Payment of the cost of said project will be made from cash on hand and/or received, payable from any fund or funds of OWNER which may be legally used for such purpose, including, but not limited to, any of the following sources, or any combination thereof, at the sole discretion of OWNER: (1) past and/or future earnings of OWNER’S utility; (2) proceeds of the sale and issuance of General Obligation Bonds and/or revenue bonds (or project notes anticipating the sale of such bonds); (3) federal, State or local grants or loans; and (4) proceeds from the sale of warrants, as authorized by Section 384.57 of the Code of Iowa. Payments will be made to the Contractor in accordance with the Contract Documents.
